Section 1

About these terms

These Terms & Conditions apply to your use of the Creator Clash website and to purchases made through our online shop. They form a contract between you and I Made This Limited, operating as Creator Clash, once we accept your order.

By using the website, creating an account or placing an order, you agree to these terms. If you do not agree, please do not use the website or place an order.

These terms are written for consumers buying physical products. They do not limit or exclude rights that cannot lawfully be limited or excluded, including rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Our Refund, Returns and Cancellation Policy, Privacy Policy, Cookie Policy and Acceptable Use Policy form part of the wider rules for using Creator Clash. If a specific policy gives you a consumer right, that right applies even if a general statement in these terms is inconsistent with it.

Section 2

What these terms cover

In these terms, “we”, “us” and “our” mean I Made This Limited, operating as Creator Clash. “You” and “your” mean the person using the website or placing an order. “Products” means the physical goods described on the website, including cards, packs, decks, accessories, bundles and other Creator Clash merchandise.

The website may also contain information about the Creator Clash card game, lore, creators and community. Those pages are provided as part of the website and are not a promise that a particular product, creator or feature will remain available.

Section 3

Who can order and where we deliver

You must be able to enter into a legally binding contract to place an order. If you are ordering for another person or organisation, you confirm that you have authority to do so and that you will make these terms available to them.

We currently accept orders for delivery only to addresses in the United Kingdom. The checkout may reject an address outside the UK. Please do not use a freight forwarder or arrange onward delivery outside the UK without our written agreement.

If we discover that an order cannot be delivered to the address supplied, we will contact you. If we cannot agree a practical solution, we may cancel the order and refund payments made for it.

Section 4

Accounts and account security

Some features may require an account. Give us accurate information and keep it up to date so that we can contact you, process orders and provide support.

  • Keep your password and sign-in details confidential.
  • Do not use another person’s account or pretend to be another person or organisation.
  • Tell us promptly if you believe your account has been accessed without permission.
  • Do not create accounts to evade purchase limits, promotions, restrictions or an earlier suspension.

You are responsible for activity carried out using your account unless it occurred without your permission and you took reasonable steps to keep your account secure. We may ask you to verify information where this is reasonably necessary to protect an account, payment or order.

Section 5

Products, availability and descriptions

We try to keep product names, descriptions, images, dimensions and availability accurate. Images are for illustration and the colours shown on your device may not exactly match the physical product. Small differences in packaging, printing or presentation do not change the product description or your statutory rights.

Products are subject to availability. A product in your basket is not reserved until we accept your order. We may set reasonable quantity limits, withdraw a product, or correct an obvious description or stock error before accepting an order.

If a product becomes unavailable after you have paid but before we can fulfil it, we will tell you and refund the unavailable product (and any delivery amount that should be refunded) without undue delay. We will not substitute a different product without your agreement.

Section 6

Prices, taxes and promotions

Prices are shown in pounds sterling (GBP). The product price, any applicable tax, delivery charge and the total payable will be shown before you place your order. The amount shown at checkout is the amount we will ask you to pay for that order, subject to correction of an obvious pricing error before acceptance.

Our current standard tracked UK delivery charge is £3.99. Delivery is currently free when the order meets the £50 threshold shown at checkout. Delivery offers may have additional conditions, and the checkout total is the final amount for the order.

Promotion codes, discounts, bundles and other offers are subject to the conditions shown with the offer. Unless the offer says otherwise, a code may be used only once, cannot be exchanged for cash and cannot be combined with another offer. We may reject a code that is invalid, expired, used contrary to its conditions or obtained by mistake or misuse. A promotion does not remove your statutory rights.

Section 7

Orders and contract formation

Before submitting an order, check your products, quantities, delivery address and total carefully. You can correct errors during checkout. When you click the payment button, you are making an offer to buy the products in your order at the displayed price and on these terms.

We will normally send an acknowledgement that we received your order. That acknowledgement is not necessarily acceptance. A contract is formed when we send an order acceptance or dispatch confirmation, or otherwise expressly tell you that we accept the order. We may decline an order before acceptance for reasons including unavailable stock, an obvious price or description error, a delivery restriction, payment failure, suspected fraud or a breach of these terms.

If we decline an order after payment has been taken, we will refund the payment by the original payment method without undue delay. We may split an order into more than one parcel, but we will not charge an additional delivery fee unless you agree to it.

We will make these terms and the order details available in a form you can save, such as an email or order record. Keep your order confirmation and any dispatch message for your records.

Section 8

Payment and payment providers

Payment is processed through Stripe and the payment methods offered at checkout. Depending on your device, location and eligibility, checkout may offer cards, Apple Pay, Google Pay, PayPal, Link, Klarna, Clearpay or another method shown there. Each provider may have its own terms and privacy information.

You must use a payment method that you are authorised to use. Payment must be authorised before we can process the order. If a payment is reversed, disputed or remains unpaid, we may pause fulfilment or cancel the order, subject to your legal rights and any refund due.

Stripe may offer a facility to save a payment method for a future purchase. Any saved payment method is handled under the relevant provider’s terms and controls. We do not ask you to send full payment-card details to us by email or through the support form. See our Privacy Policy and Cookie Policy for more information about data and payment technologies.

Section 9

Delivery, risk and title

We currently use tracked UK delivery. The estimated delivery time shown at checkout is normally 2–4 business days after dispatch, excluding any period stated for a pre-order or other product-specific release. We will provide any more specific delivery information shown on the product or checkout page.

Unless we agree a different period with you, we will deliver without undue delay and no later than 30 days after the contract is formed. If a delivery date was essential, or if we fail to deliver within an agreed or legally applicable period, you may have the right to end the contract and receive a refund. The delivery remedies in our Refund, Returns and Cancellation Policy explain how to contact us.

Please make sure that the delivery address and contact details are correct and that someone can receive the parcel. You remain responsible for extra costs or delay caused by an incorrect or incomplete address, unless the problem was caused by us.

Risk in the products passes to you when you, or a person you nominate (other than the carrier), takes physical possession of them. Ownership passes when we have received full payment and the products have been delivered. These rules do not affect any statutory right you have if a parcel is lost, damaged or delivered incorrectly.

Section 10

Cancellation, returns and refunds

You can cancel an order before dispatch by contacting us as soon as possible. For most online purchases, you also have a statutory 14-day cooling-off period after delivery, subject to the legal exceptions explained in our Refund, Returns and Cancellation Policy.

That policy explains how to notify us, how a DPD collection from a UK address may be arranged, when a change-of-mind return cost may be deducted from the refund, and when we pay the return cost. It also contains the rules for delivery refunds, partial returns, bundles, pre-orders and our model cancellation form.

Nothing in these terms requires you to accept store credit instead of a refund to which you are legally entitled. Refunds will normally be made to the original payment method and within the legal timescales described in the refund policy.

Section 11

Faulty, damaged or incorrect products

Products must be of satisfactory quality, fit for their ordinary purpose, match their description and comply with other terms implied by law. If a product is faulty, damaged on arrival, not as described or the wrong product, tell us through the support form or the contact details below. Please include your order number and photographs where they help us understand the problem, but do not delay a legal notice while gathering evidence.

Depending on the circumstances and the time since delivery, you may be entitled to a repair, replacement, price reduction or refund under the Consumer Rights Act 2015. We will not treat normal wear and tear, accidental damage after delivery or misuse as a manufacturing fault, but we will assess the facts fairly and explain our outcome.

We will not ask you to pay a return or collection cost where the law requires us to bear it. See the Refund Policy for the process and for the distinction between fault-related returns and change-of-mind returns.

Section 12

Randomised products and bundles

Some Creator Clash products may contain randomised cards or contents. Where a product description identifies the contents as random, you are buying the stated product and its stated odds or configuration, not a guarantee of a particular card, creator or outcome. A preference about random contents does not by itself make a product faulty or misdescribed. You may still use any statutory cooling-off or other cancellation right, subject to the process and any lawful deduction explained in our Refund Policy.

Sealed products should remain sealed if you wish to cancel for a change of mind. The Refund Policy explains how opening or handling a product beyond what is reasonably needed to inspect it may affect a lawful deduction for loss in value. This does not remove rights relating to faulty, unsafe or misdescribed products.

Where a bundle or promotion includes a free or discounted item, the refund for a partial return may take account of the offer conditions and the value of what is kept. We will explain any deduction and will not use a promotion to reduce a statutory refund unlawfully.

Section 13

Acceptable use

Use the website, shop, accounts and support services lawfully and respectfully. You must not use them to commit fraud, place unauthorised orders, abuse payment or refund processes, bypass quantity or delivery restrictions, interfere with the website, scrape or harvest data without permission, distribute malware, or harass other users, creators or staff.

Our Acceptable Use Policy gives more detail about prohibited conduct, content, security and enforcement. If there is a conflict, the more specific rule for the feature or activity applies, subject always to your statutory rights.

Section 14

Intellectual property

Creator Clash names, logos, artwork, card designs, characters, lore, product images, text, software and other website content belong to us or our licensors. We give you a limited, personal, non-exclusive and revocable permission to access the website and use its content for ordinary personal, non-commercial purposes.

You must not copy, reproduce, modify, sell, distribute, publicly display or create derivative works from our content except where the law allows it or we give written permission. Buying a physical product does not transfer copyright, trade mark rights or other intellectual property in the product or its artwork.

If you send us feedback, ideas, photographs or other material through a feature that invites submissions, you confirm that you have the right to send it. You allow us to use it to operate, improve and promote Creator Clash, subject to our Privacy Policy and any feature-specific terms. Do not send confidential payment information or material you do not have permission to share.

Section 15

Third-party services and links

Payment, delivery, authentication, hosting and other features may be provided with help from third parties. Third-party providers may apply their own terms, privacy notices and service limitations. We remain responsible for our obligations to you as the seller, but we are not responsible for a third party’s independent service where that service is outside our reasonable control.

The website may link to third-party websites or platforms. Links are provided for convenience and do not mean that we endorse or control those websites. Check their terms and privacy information before using them.

Section 16

Website availability and changes

We aim to keep Creator Clash available and accurate, but we do not promise that the website, account areas, product pages, checkout or support channels will always be uninterrupted, secure or error-free. We may carry out maintenance, make changes, remove features or temporarily restrict access to protect the website, users or our systems.

Website content is provided for general information and is not professional, financial, medical or other specialist advice. If a product page or checkout display conflicts with an obvious error, contact us before ordering so that we can correct it.

Section 17

Liability and legal rights

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of your statutory consumer rights, defective products where liability cannot lawfully be excluded, or anything else that the law does not allow us to exclude or limit.

If you are a consumer, we are responsible for loss or damage that is a foreseeable result of our breach of these terms or our negligence. We are not responsible for loss that was not foreseeable, for loss caused by your breach or misuse, or for business losses where you use the website for a commercial purpose and that use was not agreed with us.

These terms do not reduce your right to reject goods, request a repair or replacement, seek a price reduction, cancel an order or obtain any other remedy available under consumer law.

Section 18

Events outside our control

We are not responsible for delay or failure caused by an event outside our reasonable control, such as severe weather, fire, flood, epidemic, industrial action, transport disruption, utility or hosting failure, cyber incident, war, civil emergency or a decision by a public authority. We will take reasonable steps to reduce the effect and tell you when we can.

If an event continues for a significant period, you may contact us to discuss ending an affected order. This section does not remove your cancellation, delivery or refund rights where the law gives them to you.

Section 19

Suspension, termination and changes

We may suspend or close an account, refuse access or stop a feature where reasonably necessary for security, fraud prevention, maintenance or a serious or repeated breach of these terms or the Acceptable Use Policy. We will take account of the circumstances and will not use a suspension to remove rights you already have under consumer law.

You may stop using the website or ask us to close your account. Closing an account does not cancel an accepted order or remove rights relating to a previous purchase.

We may update these terms from time to time. The version displayed when you place an order applies to that order. Changes will apply to future use and future orders from the date shown at the top of this page. If a change materially affects an accepted order, we will tell you and seek your agreement where required.

Section 20

Governing law and jurisdiction

These terms and any contract for products are governed by the law of England and Wales. If you are a consumer living in Scotland or Northern Ireland, you also retain any mandatory protections and may bring proceedings in the courts of the part of the UK in which you live where the law allows.

We hope to resolve concerns informally first. Please contact us so that we can investigate a complaint before you take formal action. Nothing in this section stops you using any statutory complaint, dispute or court process available to you.
